Who Made This New Kids on the Block Button? 🎤 Read the Rim. That Company Is in the Law Books.

Tip this button sideways and there are two lines of red type around the rim. One names the little shop that pressed it. The other says ©1989 BIG STEP PRODUCTIONS, INC. - and Big Step, a New York corporation, is one of the plaintiffs in New Kids on the Block v. News America Publishing, the case the Ninth Circuit decided on July 24, 1992, which gave American trademark law its nominative fair use test. Law students still read it. Not bad for a mall-rack pin a kid paid a couple of bucks for.

These are 1989 New Kids on the Block pinbacks from Button-Up of Troy, Michigan, an inch and a half across, new old stock out of unsold period inventory and never pinned on a jacket. On the front is a full-color photo of all five on a cream background - get close and you can see the halftone dots, real offset printing - with the slanted red NEW KIDS ON THE BLOCK logo across the lower right. Around the rim: BUTTON-UP 2011 AUSTIN TROY, MI 48083 on one side and the Big Step copyright on the other. The back is a cream molded plate with a nickel bar pin and a locking clasp. And that 2011 fools everybody - it isn't a year, it's the street number on Austin. The date on this button is the 1989 copyright.

⚖️ How Big Step got into the casebooks

USA Today and The Star both ran pay-per-call polls - dial this number and tell us your favorite New Kid - and kept the money. The band's partnership and companies sued for trademark infringement, false advertising and unfair competition, ten counts in all; the caption names all five of them plus Dick Scott Entertainment, Info-Tainment, Winterland Concessions and Big Step Productions, Inc. They lost, and how they lost is the whole point. The court said that when the only sensible way to talk about something is by its name, using the name isn't infringement - you can't poll people about the New Kids on the Block without saying New Kids on the Block. That became the three-part nominative fair use test, one of the most cited ideas in trademark law, all because a couple of papers wanted fifty cents a call from teenagers voting for Jordan.

🏭 Button-Up of Troy

Before you could order buttons off your phone, they came out of small regional shops that turned band photos, cartoon characters and birthday gags into tin you could wear. Button-Up ran its presses in Troy, a Detroit suburb in Oakland County, and its rim line shows up on a whole run of licensed 1980s pins - a Bon Jovi portrait, a big Simpsons pin from the show's first year, over-the-hill and humor pins. It was no back-room bootlegger, either. Button-Up turns up in federal court records as a Michigan corporation sitting with Topps, Bantam Books, Penguin USA and Dick Scott Entertainment in suits over New Kids merchandise.

One of those suits is worth knowing. New York photographer Bette Marshall shot the band at a session around September 20, 1989, licensed for public relations, the tour book and the fan club, for one year, with every photo credited to her. She sued, saying her pictures had turned up uncredited on trading cards, tablecloths, paper plates, wallet cards, posters and buttons, and in December 1991 the court let her claim go forward. Both names on this rim are on the defendants' list - Button-Up, and Big Step, which the court said owned the New Kids on the Block trademark itself. Nothing in the record ties a particular photo to a particular button, but photo rights and button rights were fighting it out in federal court over exactly this kind of thing in exactly these years.

🏙️ Troy, the town with no downtown

Troy got settled by people coming west from New York - overland through Ohio or by the Erie Canal and the lakes - who named it after the Troy most of them had left. In spring 1821 Johnson Niles bought 160 acres in Oakland County, went back east for his family, brought them to Detroit by schooner, built a log house and started trading; the settlement became Troy Corners, and in 1823 Niles was its first postmaster. By the 1880s the township was known for corn, wheat, melons, wool and dairy.

What it never had was a reason for a Main Street. No water power for a mill, and the Detroit & Milwaukee Railroad went right past Troy Corners without a stop. Troy didn't incorporate as a city until 1955, mostly to keep the neighbors from annexing it a field at a time. It took the motto The City of Tomorrow, Today and built just that: 13,217 people at incorporation, 67,102 by 1980, and a light-industrial corridor south of Big Beaver Road laid out for trucks, not trains. That's where Button-Up was - 2011 Austin Drive, ZIP 48083. A manufactured pop sensation's merchandise, pressed in a town that built itself from scratch.

Troy was also a funny little capital of mass-market pop. Kmart's world headquarters, Fort Kresge, sat on Big Beaver Road from 1969 until 2006. The Handleman Company, the rack jobber that stocked music, video and software racks in the big discount stores and was Kmart's only music supplier for decades, was based there too. And Carl Thom started the Harmony House record chain in the late 1940s in Hazel Park, a few miles south, and grew it to 38 stores, most around metro Detroit, every one with a Ticketmaster outlet. That corner of Oakland County helped warehouse, rack and sell pop music, and the concert tickets, to the suburbs.

🎶 Five kids from Boston

It starts with Maurice Starr, who'd made New Edition stars and then lost them to a bigger label. Out to prove the formula, he went back into Boston's neighborhoods in 1984. A talent agent found fourteen-year-old Donnie Wahlberg in Dorchester; Donnie brought in Danny Wood and Jordan Knight, Jordan brought his brother Jonathan, and Joey McIntyre of Jamaica Plain came last and youngest. They were Nynuk for a little while, and the story fans have told for thirty-some years is that the name they kept came out of a song Donnie had already written.

Several of them were bused across town under Boston's school desegregation order, and by their own later accounts it was tense outside the school doors. Donnie Wahlberg has talked about being sent as a first-grader from Irish-Catholic Dorchester into mostly Black Roxbury, and he's credited that with opening his ears to the music that shaped his career. Think about that - a white Boston group built to echo New Edition's sound came, in a real way, out of a court-ordered busing map. Most of the kids singing along in 1989 never gave it a thought.

📈 1989

The first album barely made a ripple. Then Hangin' Tough came out on August 12, 1988, and by the end of 1989 it was number one on the Billboard 200 and the second-best-selling album of the year, behind Bobby Brown's Don't Be Cruel. It went eight times platinum, and all five singles made the Hot 100 top ten, which no teen act had ever pulled off from one album. Governor Michael Dukakis gave them their own day in Massachusetts, April 24, 1989.

Then came the merchandise - dolls, lunch boxes, sheets, clothes, and little cheap things just like this button, an estimated four hundred million dollars' worth of licensed goods in 1991 alone. That year they topped Forbes' list of the highest-paid entertainers in America, ahead of Michael Jackson, Madonna, Prince and Bill Cosby, and in 1990 they'd grossed about $74 million from 152 North American shows. The fall came quick. Lip-syncing accusations surfaced after Milli Vanilli; they broke off an overseas tour to sing live on national TV, and the accusation was withdrawn, but grunge and hip-hop were already taking over. They split from Maurice Starr in late 1993, went out as NKOTB, and were done in 1994 - top of the Forbes list one year, off the bottom of its top twenty two years later.
